Two terms of use name AI tools
JPMorgan Chase and T Mobile list AI among the ways of using their sites that customers may not use. The scan found no exception for an agent a customer has authorized.
Finding, October 1, 2026, 3 minute read. By Encore AI.
Most terms of use were written before customers had agents. Two of the six organizations we scanned now address AI directly. This is what the text says, as read on October 1, 2026.
JPMorgan Chase
Unauthorized entry and use of JPMorgan Chase’s systems includes the use of agents, including AI agents or agentic AI
The sentence follows a statement that misuse of information posted to a site is strictly prohibited. It goes on to list robots, spiders, scripts and software, so the list covers many kinds of automation and names AI agents.
T Mobile
You agree not to: … access, monitor, or copy any content or information on the Site using any robot, spider, scraper, artificial intelligence tool …
This sits in a list of prohibited uses. It covers reading and copying content with an AI tool, which is what an agent does when it looks up a plan or a bill for a customer.
What the scan found around them
- Neither document gives an exception for an agent that a customer has authorized.
- JPMorgan Chase publishes no developer program and no OAuth metadata on the hosts that answered.
- T Mobile publishes OAuth metadata, but its home page returned an error to a declared agent.
Why it matters for agents
A customer who asks an agent to check a balance or a bill is the person the site was built for. A published rule that lists the agent as a restricted tool leaves the customer without a supported way to delegate the task. A developer program with customer consent gives agents a place to go.
For comparison, the terms the scan read for Ally Bank are silent on agents. Silence leaves the question open. A named restriction answers it.
